Real Estate and Land Use Law
Our real estate and land use attorneys handle a wide range of matters for clients. Of course, we negotiate and document the purchase or sale of property, with or without buildings, with or without an associated business. Many sales transactions in the cannabis and hemp industries utilize “seller-carried” financing, either in the form of a promissory note and a deed of trust or by land sale contract. We have handled many such transactions, representing sellers, buyers or lenders in a given matter. We handle many traditionally financed real estate transactions as well, and have a great deal of experience working for banks as lender’s counsel with respect to real estate-backed lending transactions, including in instances where the FDIC has stepped in as receiver.
We also handle a significant volume of commercial leasing work and have negotiated and drafted leases for retail use, agricultural use, warehousing, manufacturing and for restaurants, bars and medical professionals. Within the cannabis and hemp industries, we have negotiated, drafted and reviewed literally hundreds of commercial leases and we regularly see industry-specific provisions we originally devised in leases drafted by other lawyers.
Our land use and development practice ranges from analysis of preliminary property and building permitting issues to complex land use review and hearings. We appear for and with clients at planning commission and city council meetings, for example, and have successfully worked with clients to implement their vision notwithstanding the demands and constraints of local government review and approval.
